On July 27th, 2023, Senators McMorris Rodgers, Cassidy, Pallone Jr., and Sanders issued a Request for Information (RFI) to the public, inviting your insights on how CBD products should be regulated in food and dietary supplements. This call to action comes after the Food and Drug Administration (FDA) signaled its intent to collaborate with Congress on crafting a legislative framework for CBD product regulation. The FDA's stance has been cautious due to CBD's association with the drug Epidiolex. The agency acknowledges the need for a comprehensive approach. Now, your thoughts can help shape this vital legislation.

What Topics/Questions Does Congress Want To Hear Your Thoughts On? 

• Current market dynamics, like market changes since the 2018 Farm Bill, current products in the industry, and the effect of the lack of national standards.

• Rules and regulations, such as hemp product definitions, the adequacy of FDA’s current rules as they relate to CBD, products not meant to be eaten or consumed, and the rise of synthetic cannabinoids.

• Federal-State relationships, including how states are currently regulating CBD products and how federal law should or should not prevent those regulations.

• Safety and quality concerns of allowing CBD in food or dietary supplements, like interactions with other substances, inherent risks, consumer safety, and limits on amount/concentration.

• Packaging and labeling issues, such as potentially standardizing label panels, as well as claims, symbols and other possible restrictions allowed on packaging.
